ANÁLISE DO PATRIMÔNIO NATURAL E CULTURAL DO GEOPARK ARARIPE/CE A PARTIR DA LEGISLAÇÃO AMBIENTAL PERTINENTE

RESUMO O presente artigo tem por finalidade analisar o Geopark Araripe (CE), sob a ótica da legislação ambiental brasileira, notadamente quanto à proteção do patrimônio natural, geológico e cultural dos atributos ambientais presentes no território. Foram utilizados dados de origem secundária, tanto de ordem técnica quanto de ordem jurídico-institucional, para fundamentar a análise e discussão da efetiva proteção do patrimônio natural e cultural na área em estudo. Os resultados apontam que o patrimônio natural e as paisagens naturais do Geopark Araripe estão protegidos por meio da instituição de diferentes categorias de Unidades de Conservação, perfazendo um total de 71,80% do território sob proteção legal. Quanto aos usos legais e usos ilegais, de fato, há uma postura conciliadora de proteção do patrimônio natural e geológico, com o desenvolvimento socioeconômico na região, existindo ação coercitiva no sentido de proibir o contrabando de fósseis, seja por intermédio da existência de leis que configuram esta proteção, seja por meio de sua execução pelos órgãos competentes. Concernente à proteção do patrimônio cultural, infere-se que os valores da biodiversidade, da pluralidade e da heterogeneidade cultural foram incorporados como elemento fundamental no padrão de desenvolvimento do território do Geopark Araripe/CE. Depreende-se, por fim, que as normas jurídicas que permeiam o universo de proteção do patrimônio natural e cultural do Geopark Araripe/CE são suficientes para sancionar condutas, individuais ou coletivas, que possam gerar efeitos negativos, sobretudo, relacionado ao patrimônio geológico. ABSTRACT This paper intends to analyze the Araripe Geopark – State of Ceara (CE), under Brazilian environmental laws, mainly concerning natural, geological and cultural protection of local environmental features. Secondary data were used, both technical and legal ones to achieve analysis and discussion about effective protection of natural and cultural heritage. The results show that the natural heritage, and also natural landscapes of the Araripe Geopark, is protected through the establishment of different types of protected areas, getting about 71.80% under legal protection. Concerning legal and illegal uses, there is indeed a conciliatory approach to natural and geological heritage protection, with the socioeconomic development, existing enforcement action to forbid fossils smuggling, or through the existence of laws that set this protection, either through its implementation by relevant agencies. Concerning protection of cultural heritage, it is inferred that biodiversity, cultural plurality and heterogeneity values were incorporated as a fundamental features in the pattern of development of Geopark Araripe´s territory. Finally, it could be said that legal norms established to protect the natural and cultural heritage Geopark Araripe / CE are sufficient to punish conduct, individual or collective, that can generate negative effects, particularly related to geological heritage.
